Ron DeSantis (R) said Thursday his state “will not comply” with recently unveiled changes to Title IX by the Biden administration.

“Florida rejects [President Biden’s] attempt to rewrite Title IX,” DeSantis said in a video posted to the social platform X. “We will not comply, and we will fight back.”

“We are not gonna let Joe Biden try to inject men into women’s activities,” DeSantis continued. “We are not gonna let Joe Biden undermine the rights of parents, and we are not gonna let Joe Biden abuse his constitutional authority to try to impose these policies on us here in Florida.”

The Biden administration unveiled a final set of changes to Title IX last week that add protections for transgender students to the federal civil rights law on sex-based discrimination. The changes will take effect in early August.

“These final regulations build on the legacy of Title IX by clarifying that all our nation’s students can access schools that are safe, welcoming, and respect their rights,” Education Secretary Miguel Cardona said in a statement.

DeSantis has been criticized by LGBTQ advocates in the past for state laws they say harm their community, including the so-called Don’t Say Gay law that restricts discussion of LGBTQ topics in Florida public schools.

Under Title IX statutory language, along with the OCR enforcement schemes relative to Title IX, remember the following:
--Title IX is not considered a “sports law” – the OCR considers athletics an education program and enforces it as such. (Consider how this implicates transgender athletes.)
--Title IX does not only protect females, it protects all students (males and females), faculty and staff.
--Title IX covers sexual harassment/sexual assault in schools.
--Title IX requires schools to maintain policies, practices and programs that do not discriminate against anyone based on sex. (Consider the current U.S. Supreme Court definition of sex.)
--Title IX is at the heart of efforts to create gender equitable schools. Males and females are expected to receive fair and equitable treatment in all arenas of public schooling. (Consider what “gender equity” means in this context.)

If anything, Riley Gaines, Selina Soule and others in their position are the ones violating Title IX, not the trans athletes because so long as the above reigns true, trans athletes have as much a right to compete as do cisgender female athletes. Period, end of story.

Indeed, after the Emplotyment Cases (Bostock et. al, 2020) one has to wonder when/if SCOTUS will apply the same logic they used in those cases to Title IX.

Come to think of it, @DrLeftover, here's a question: why is it the discrimination against trans athletes here occurs with trans women and not trans men?

Going back to the article I quoted earlier...

Before the state laws started changing, most transgender athletes designated themselves by gender identification irrespective of the gender designation on the birth certificate. Now that some states are requiring that all participants for sports identify and participate by what is on the birth certificate, omitting reliance on gender identity, how does the constitutional concept of “equal protection” apply?

A general overview of the emerging state laws that limit transgender athletic participation fall in two general categories:
--Females transitioning to males can participate without restriction on either boys or girls teams; and
--Males transitioning to females are restricted (or banned) from participating on girls teams.

The law applies to males transitioning to females differently from females transitioning to males. This is clearly contrary to the specific wording of Amendment XIV, Section 1 – “No state shall make or enforce any law which shall…. deny to any person within its jurisdiction the equal protection of the laws.” It was only a matter of time that this type of law would be challenged on an “equal protection” basis.

One bigoted video calling trans athletes men doesn't apply anything to the argument. Nor does that particular person "proving a point" by claiming to identify as a woman and entering a competition. Trans athletes are subject to standardized testing in most sports, it's not trans people's fault one Canadian sport does things that way, nor is it trans people's fault some people are ignorant of science.

Trans women are not men, not even "former men," and to imply such is dismissive of what it is to be trans. Whether you approve or not, show a little decorum.
